Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the ResponseRise online training hub, website, subscription plans, and related services (collectively, the “Platform”).

ResponseRise is based out of New Zealand and operates in accordance with New Zealand law. By accessing or using the Platform, you agree to be bound by these Terms.

If you do not agree with these Terms, you must not access or use the Platform.

Definitions

  • “We”, “us”, “our” refers to ResponseRise.

  • “User”, “you” refers to any individual or organisation accessing the Platform.

  • “Content” means all training materials, videos, text, graphics, assessments, certificates, and resources provided through the Platform.

  • “Subscription” means a paid or free plan providing access to the Platform for a defined period.

Accounts and Access

a. Individual and Organisational Accounts

  • Subscriptions may be purchased by individuals or organisations.

  • Organisational or enterprise subscriptions may include multiple sub-user accounts for staff, contractors, or authorised representatives of that organisation.

  • The organisation is responsible for managing, assigning, and removing sub-user access.

  • Each user must have their own unique login credentials.

b. Account Sharing Prohibited

  • Login details must not be shared between individuals.

  • Access must not be provided to anyone outside your organisation or business.

  • Accounts and sub-user access must not be resold, transferred, or shared externally.

We reserve the right to suspend or terminate accounts where unauthorised access, misuse, or account sharing is detected.

Subscriptions, Billing, and Cancellation

  • Subscriptions are billed annually or monthly and automatically renew at the end of each billing period unless cancelled prior to renewal.

  • Organisational or enterprise subscriptions are billed to the purchasing entity.

  • You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period.

  • No refunds are provided for any subscription fees, including partial periods, unused access, or cancelled subscriptions.

  • If a user is on a trial period, the payment details provided by the user will be charged automatically at the end of the trial period. The user understand they may not receive a notification email advising of their trial period ending.

All payments and subscription management are handled through MemberPress and associated third-party payment provider Stripe.

Use of the Platform

You agree to use the Platform:

  • Lawfully and in accordance with these Terms

  • Only for your own personal or internal organisational use

  • In a manner that does not infringe the rights of others or compromise the security of the Platform

You must not:

  • Attempt to gain unauthorised access to the Platform or its systems

  • Interfere with or disrupt the Platform or its services

  • Use the Platform for any unlawful, harmful, or abusive purpose

Intellectual Property and Content Restrictions

All Content on the Platform is owned by or licensed to ResponseRise and is protected by intellectual property laws.

For organisational or enterprise clients:

  • Access to Content is limited to authorised users within the organisation only.

  • Content may be used solely for internal training and awareness purposes by approved users.

You must not, without our prior written consent:

  • Download, copy, reproduce, or store any Content.

  • Share, distribute, resell, or sublicense content

  • Record, screen-capture, photograph, or otherwise duplicate Content

  • Use Content for external training, commercial purposes, or redistribution

Access to the Platform grants you a limited, non-transferable, revocable licence to view Content for permitted internal use only.

Assessments and Certificates

  • Some courses may include assessments that must be completed to a required standard to obtain a certificate.

  • Certificates are issued based on successful assessment completion, not attendance.

  • Certificates issued through the Platform:

    • Do not constitute a formal qualification

    • Do not provide professional, legal, medical, or regulatory certification

    • Are intended for general training and awareness purposes only

We reserve the right to withhold or revoke certificates where misuse, breach of these Terms, or misconduct is identified.

Educational Use and Disclaimer

All training provided through the Platform is for general educational purposes only.

The Content does not constitute legal advice, medical advice, operational directives, or professional instruction specific to your circumstances.

You acknowledge that:

  • You are solely responsible for how you interpret and apply the training

  • ResponseRise accepts no responsibility or liability for actions taken or outcomes resulting from the use of the Content

Limitation of Liability

To the maximum extent permitted by law:

  • We exclude all warranties, representations, or guarantees not expressly stated in these Terms

  • We are not liable for any direct, indirect, incidental, or consequential loss arising from your use of the Platform

Where liability cannot be excluded under New Zealand law, our liability is limited to the amount paid by you for the relevant subscription period.

Suspension and Termination

We may, at our sole discretion, suspend or terminate individual user accounts, sub-user accounts, or organisational access immediately if we believe there has been:

  • Misuse of the Platform

  • Abusive, threatening, or inappropriate behaviour

  • Breach of these Terms by an individual user or an organisation

For organisational subscriptions, breaches by individual users may result in suspension of the individual account and/or the wider organisational account.

Termination does not entitle you to any refund.

Availability and Support

  • Access to the Platform is provided on an “as available” basis.

  • We do not guarantee uninterrupted access or error-free operation.

  • We may modify, suspend, or discontinue any part of the Platform at any time.

Governing Law and Jurisdiction

ResponseRise is based in New Zealand.

These Terms are governed by and interpreted in accordance with the laws of New Zealand.

You agree that any disputes arising in connection with these Terms or your use of the Platform are subject to the exclusive jurisdiction of the courts of New Zealand.

Changes to These Terms

We may update these Terms from time to time. Updated versions will be published on the Platform and take effect from the date of publication.

Newsletter and Email Marketing

By accepting these terms and conditions, the user and sub-users agree to receive email marketing from ResponseRise. If the user or sub-user wishes to opt-out of email marketing, please contact us below.
